    Wording on Application to TT

    I am about to submit my first application to the TT. As most common it is to get back missed rent.

    What wording should I use to ensure that I get a sealed order that gives an attachment against the tenant's benefit or an eviction if more rent is missed.

    I have already issued the 10 day notice.

    Muahahaha! If only it were that easy grasshopper...

    Firstly, you need to specify what you are going to be claiming for including amounts if possible. If not, then you'll need to bring receipts or quotes to the hearing. Claim everything at the one hearing or you'll end up with multiple orders which makes life more difficult. Make sure you have a printout of the tenants payment history. The Tenancy web site has a form.

    The most important thing to note is that the tribunal does not give attachment orders. They simply make a decision on what happens next. ie; Pay $X of arrears you naughty tenant OR Get out in X hours. They don't do deals like "pay your rent or the landlord can kick you out when he wants".

    Once you have the tribunal order (lets say for payment of arrears), then you either sort out payment direct with the tenant or you have to pay for an Order of Examination where you sit with them and a court officer and decide a repayment plan. You should organise an attachment order to their wages/benefit at the same time. You have to pay court fees up front for this but it is added on to their debt.
