S&P ninth edition gurus, here's a question for you.

Hi all, I've had a conditional offer accepted on a fairly large rural bare land block. I have put a range of conditions on it just to buy myself a bit of time really - 15 days due diligence and 45 additional days settlement period. I should be ready to settle in a day or so, about a month and a half early but there's just one little thing that those S&P agreement experts out there might be able to "shed" a bit of light on for me.....

The property has some stuff on it.

Two small sheds and their contents. the contents I don't care about and the vendor has specifically excluded "contents of shed" in the agreement. obviously the (empty) sheds come with the property that goes without saying and there's nothing about them in the agreement.

One large forestry skidder, condition unknown. I don't know if this machine runs or not or if it's just a relic, but the agent doesn't know who owns it and there's nothing about it in the agreement.

So, if settlement day comes around and this thing is still there is it mine? If so and some bloke shows up to claim it after a while do I have to let him take it?

    Cheers
    Sparx
