Advice on selling privately....

    I am an ex agent but I have been an investor for the last 7 years. And the reason is, I got sick and tired of dealing with the likes of you.

    Several people here have said that agents are of dubious character etc. What about the 'general public' who ask for advice on how to stiff an agent? That's ok is it? That shows character does it?

    I was glad to read a few people standing up for the agents. I have done it for 4 years ('96 to 2000) when things were harder. Yes they have had an easy time lately but that will change again shortly.

    To anyone who reckons it's easy money, I have just one piece of advice, try it. Get a job as a salesperson and see how easy it is. I can tell you it is the hardest job I have ever had and I will never ever do it again! Investing is about 1 million times easier and I'm not exaggerating.

    Now, Gizmo, when you signed the agency agreement you must have known a commission would need to be paid. If you don't want to pay it, why did you get a real estate agent to sell your property?

    And then when their sign generates a good lead, (the purchaser goes behind the agents back) you want out.

    Nothing to do with ethics, morals or character, you like most of the "good honest public" have none. What you are really asking for is a kind of 'permission' from people here to do what you want to do i.e. stiff the agent and save some money.

    Agents have better things to do than meet with vendors, go over marketing plans, sign up agency contracts, undertake advertising and put up signs and then have that same vendor say "Thanks for all your free work, now you've found us a buyer, we'll take it from here and pay you nothing".

    The fact that this is seen to be ok by a lot of people is a big worry. It's simiar to insurance fraud and other crimes like that where people assume the people or institutions they're doing the dirty on are really rich and won't notice the difference and are basically all dishonest themselves anyway.

    If it makes you sleep better at night to think all agents are crims, then fine, tell yourself whatever you need to while you complete your sale privately.

    Next time, give yourself an out in the agency contract, or sell it privately from the start.

    The only reason agents get everyone to sign these agency contracts these days is precisely because so many people try and stiff the agents. Handshakes and verbal promises just fly out the window when money becomes an issue.

    And of course there are some dodgy real estate agents out there. You just have to be sensible in who you deal with as in every other facet of life.

      Both sides expressed here, and the truth is possibly somewhere in between (it usually is). Why not contact the prospect and find out what they are prepared to pay - it might all be academic if their price is too low. If it appears satisfactory ie full asking less the agents commission, there's no harm then in contacting the agent and saying you have a private buyer lined up, and ask them to do a deal to release you from their agency - about 50% of the commission sounds like a good balance to me.
      If accepted the result is you discounted your property by 50% of the agents commission. Most buyers don't pay full asking so you are probably where you would be anyway, but you have a quick sale and can get on with your life.
      The agent only gets half the commission, but before they have spent too much time on the property and the buyer gets the discount she is looking for - win, win, win!

        Going 50/50 sounds like a nice idea Julian, but my bet is it just won't fly with the agent.

        15 out of 15 for me, they have been hardnuts that would sell their grandmother to get a deal, so I'm afraid my heart bleeds for you, Davos. Still, you make a fair point. It's a chicken & egg thing in a way. Who's the nastiest and why the other has to combat it the way they do.

          You say you have to be careful who you deal with, but surely that's a moot point when it's not easy to tell and you've just been shagged up the date by some rogue agent (and it's too late).

            It is difficult to make anything from your above posts. They don't make any sense, not to me at least.

            You do however seem to be a bitter person and you also seem to have had a recent bad experience with an agent.

            Why not say what has happened (as clearly as possible please) so we can all get a better idea of why you have such a negative opinion of real estate agents.

              K1wi posts make sense to me. Of the last say 10 tenders that I have been involved with (buying) there was only 1 where the agent wouldn't tell me what the other bids were (prior to tender date or minuites after). So either the agents were lying about the other bids - very possible, or acting unethically.This happens all the time. Sometimes we then ended up with a dutch auction, sometimes not.

              I am not going to complain/moan about it, just the way it is.

              If you are being honest, I'm sure you have been in similar situations.

                The bottom line of this, as I see it, is all about our 'choices & decisions'.

                Gizmo chose not to market the property privately from the onset and made the decision to list the property as an exclusive agency for a stipulated period of time, with a salesperson of their choice working at a RE office that Gizmo decided to go too.

                Gizmo chose to sign an exclusive agreement and would more than likely hold that salesperson and their office to honour that agreement in every way, shape and form! As should Gizmo in my opinion.

                As for RE Salespeople ... that's exactly what they are - people - individuals - and as we all know, sometimes we chose the right people to work for us, look after our finances, guide us, be our friends, etc. etc. and sometimes we find out that they were not the person we thought they were - that's just part of life's journey. So just because there may be a few RE salespeople that you didn't like for whatever reasons doesn't mean they are all tarred with the same brush. Perhaps you need to try make better informed choices and learn from past experiences in a positive way rather than take all the negative aspects into you next decision/choice.

                  More lilely to be lying I would think, which in a way is unethical too.

                  However, it still needs to be taken in context. An agent with a buyer breathing down his neck might well say anything just to shut the buyer up and get him off his back(not right but understandable). Also, it could well be a perfectly normal ploy to obtain the best price for the agent's client, who is not you the buyer. In that sense the agent is doing a good job. There are too many people out there, buyers especially, who think they can get something for nothing. When they come up against an agent who is working for his client then the buyers feel annoyed that they never got ay free information and take it out on the agent. I'm not saying this has happened in your case but it is often what does happen.

                    Geeez gizmo, you've taken on the agent, so pay the commission. I'm not an agent and hate spending money on agents, but that's part of the deal, unless you feel you can do a better job yourself. Which you don't cos that's why you signed up an agent in the first place. If you dont trust the agent then you didn't do a good selection process.
                    As for K one W one, I don't think anyone here would do business with you having seen your morally defficient approach.

                      Read the listing agreement, I think you are likely to being paying a small fee after the listing has expired, if any marketing material introduced a purchaser.

                            But Xris, you blur the line between trying to obtain the best price for the vendor and acting immorally or illegally.

                            You cannot excuse crap behaviour by an agent by saying it's in the vendor's interest.

                            You asked for an example. One of my recent ones was the vendor's agent, unknown to me, contacts my building inspector (it turned out the agent knew him) and pressured him to make the report much better than it should have been. I have no idea what pressure that was, but I'm sure you can draw your own conclusions re "future work". I only found out by fluke.
