    Exterior maintenance

We have a tenant who decided to move to other premises and vacate the space they were leasing in our building with a couple of years left on the lease. They continue to pay rent and outgoings until a new tenant is found. Problem is, our other tenant has advised us that the vacated premises are having an unkempt look about them - cobwebs, dirty windows etc. which they feel is impacting on their business. Should this still be the responsibility of the tenant who moved out under their obligations to maintain the premises?

    Thanks.

    Hi Ronnigal,

Best that you give the property a bit of a tidy up. If the neighbouring tenants are concerned that it has become grubby, is it possible that prospective tenants also come to the same conclusion and dont want to rent it.

Now that the unit is empty it may be a good time to improve the "look" of the unit to passers by. Grab the bull by the horns.

Why do you think it has not rented since the ex tenants moved out?

    All the best,

    Niall

Thanks for your response Niall, the question I am asking is, doesn't keeping the premises in a tidy state which is part of the lease agreement apply, and remains an obligation even if the tenant has left the premises. That being the case, as they are still the leasees, I could get someone in to clean the outside of cobwells, dirty windows, and charge it to them.

And why hasn't it been rented out? Well, the tenant has it with a real estate, and times are tough anyway. You would think, however, if they wanted to be released from their lease, they would do everything to make the building appealing.

That answers your question. The current tenant is still responsible for everything contained in the lease until the lease is assigned to another tenant. Does the lease include a guarantor?

Thanks Dave. All sorted. Tenant has acknowledged obligations and doing something about it.

Glad you spoke to them first....it's a breach of their lease, but you need to advise them of the breach and require them to remedy before taking the bull by the horns and doing it yourself, otherwise you might find the money you spend is irrecoverable.

Looks like all's well that ends well.....unless they run out of money and default on the payments of course. Just thought I'd throw in that piece of positivity....!
