    Default Body Corp fees

    I should know this but I don't: Is there any independent body that will/can have a look at Body Corporate charges to determine if they are fair and reasonable. I have a tenant that has voiced his displeasure at the amount of his BC fees. I feel very confident they are reasonable, but it would be good if an independent authority could adjudicate on the matter.
    I have found nothing in the lease document that even suggests that BC fees have to be fair and reasonable, but the good citizen in me, and potential payer if the building should ever become vacant, thinks they should.

    I am curious!!!. Are you implying that your tenant pays the Body Corp fees? I have a number of properties that are in a Body Corporate set-up and as the owner I pay the Body Corp, the tenant pays the rent.

    Do you have a different set-up with yout tenants or did I read this wrong?

    Julian is discussing commercial property and as we know things operate slightly differently in commercial, the tenant pays for everything.

    for years with other landlords and there was a body cooperate but no fees,we just voted when improvements and maintenance needed to be carried out,worked well,food for thought.

    Thanks mals69 but you seemed to have missed what I was getting at. I want to know if there is any contactable entity where one can get impartial advice on the reasonableness or otherwise of BC fees. And yes, ivy and Londonkiwi I am talking about commercial property.

    Hi Julian,

    I donít believe there is an official body you can go to.

    The procedure for this type of dispute resolution should be covered in the Body Corporate Rules.

    Try Arbitration and Alternative Dispute Resolution Centre NZ they can appoint a mediator to solve the dispute.

    Good thoughts Josko. One of my current tenants is complaining that our insurance premiums are too high and that we shouldn't be getting the building valued for insurance purposes every two years. I feel very confident the BC is being operated professionally and all charges are fair and reasonable, but was wondering if there was a way of getting an impartial judgement.

    Hi

    I have in the past had a tenant claim the same about insurance premiums.

    So I agreed to have the building valued for insurance under the condition that he paid for the valuation.

    In the end we went halves.

    Happy tenant though.
