    Default Tenancy services, bonds and runaway tenants

    I have some tenants who are vacating and still owe me over $1200 in rent. There is a bond for $420 with TS. However, the tenants have already found a new place to rent and want me to consider the bond as part payment for rent even before they have moved out.

    What I really want to know is how can (or do) Tenancy Services accept a new bond from them when they are in arrears on their previous agreement?

    I have already lodged an application to the tribunal by the way.

    Tenancy Services responded to my question...

    Pursuant to Section 20 of the Residential Tenancies Act 1986, Tenancy Services are obligated to receive and process any Bond monies received from either a landlord or, with the landlords consent, tenant. So should a bond payment be received from your tenant or their new landlord then, yes Tenancy Services will accept that bond payment and it would be processed separately from any bond in which you are a party to and separate from your claim.
