We own and end unit on a crosslease with several others and wish to make a foot print alteration so will require their consent. Every unit has it's own back garden but on the current 1970's cross-lease there are no area's of exclusive use specified and I was hoping that in the process of redrawing the site plan this could be amended to provide each unit with it's own area. Would this be simply done by creating a new crosslease or is there now a different instrument/approach used? (Auckland)

A question for a lawyer.
I'm not sure if you just need the units plan updated to show the exclusive use areas or you'd also need a new Cross Lease agreement with the 'exclusive use' wording.
It would be an easy sell to the owners you'd think, given the units would be worth more with their exclusive use areas on the flats plans.
