The long and the short ...
Tenant has been in my property for just over 2 years. As new owner , i took him onboard from the previous owner .
He has been a poor communicator and spasmodically attended to notices sent advising him not to damage the berm by parking his truck on it.
Over the 2 years he's always paid his rent on time and kept the house in a moderately reasonable condition, though water bills were ignored mounting up to a considerable debt which was finally paid 2 weeks ago . Subsequently he has now mounted up new water arrears.
A few weeks ago he asked for a covid19 rent reduction based on reduced work hours, i obliged by giving him a temporary reduction for 8 weeks - yet he complained that i should really back date it .There was no appreciation shown, instead he became petulant saying i owned several properties and was rich enough to afford more rent reductions..
In the last week he appears to have flipped his lid as the tax man has served him with a notice of debt for 120k , around 30k of which is interest penalties alone !
He refused to let me into the property to followup on the inspection last week unless i showed him my ID . Just playing silly buggers . I knew beforehand he had problems with IRD as a few months ago they contacted me asking me to provide a copy of his tenancy agreement! On this recent followup inspection he had moved both rubbish bins inside the property , i suspect other people are going through his bins for paperwork on debts he owes ?
At the followup inspection ,I observed he was stressed and my hunch was right when i asked him if it was related to IRD . He then showed me the debt paperwork they are chasing him for over 120k and remarked that the Ministry of Justice had also recently repossessed his work vehicle and he was only able to get it back after paying them $7500. All in all a crappy situation but the chap has brought it upon himself through ignoring communications from them . I postponed that days followup inspection as nothing had been done that he was supposed to attend to and i could see he was at breaking point . I provided him an accountants phone details that may be able to address his tax debt problems. He assured me he was still able to pay rent and indicated he would look for a more affordable situation to meet his needs, he also gave an undertaking to provide keys for the un-consented lock change and pay the new water arrears this week. At the beginning of this week i issued him a termination notice of 90 days as either way he had said recently and a few months ago he was looking around at more affordable rental options.
Sadly he has not paid his rent this week , nor yet supplied keys or paid his water arrears . Instead i received a text from him saying he will get a flatmate to move in to help him pay his rent. Not much point as the termination notice is set for October.
I have issued 14 day notices regarding the keys, water and rent arrears. Its looking like i will need to apply to Tenancy Tribunal for an eviction.
Any advice?
