We have a crosslease property in Orakei, Auckland where both owners consent to the designated areas being changed. One owner will give up a parking and lawn area (for a price and installation of another easier accessed parking area).
After the changes the flat, including land will only be approx 190m2. It will also have about 50m2 of shared driveway. Total section is 950m2.
We are zoned mixed housing urban on a hillside with an outlook. From the free holding rules it looks like a site cannot be less than 300m2.
What is the story if we just adjusted the cross lease? Is there a minimum size requirement still?
