There is a swimming pool in the rental property. What is the obligation of landlord and tenant, respectively?

The Fencing of Swimming Pools Act was repealed a year or so back. The stationery used by some councils has yet to catch up with that fact - Hastings being one.

It's provisions, with some amendments, were incorporated into the Building Act.

s162C (4) (d) seems to place the responsibility for compliance on the occupant.

Doubtless, some TTKKK* could twist that to exonerate a tenant and implicate the LL.
