I have a couple of cross lease queries relating to a property I'm interested in purchasing, renovating and selling in Auckland.
- The property has a deck and sleep out both added without the consent of the cross lease neighbors (a single storey rental property located about 30 metres away). The deck is approx 500mm high so not requiring building consent, and the sleepout under 10m2. The deck and sleepout are easily located in a manner that does not impede on the neighbors privacy or quiet enjoyment, or affect driveways and parking, due to the separation distance between the houses. The agent has tried to contact the owner of the front rental to gain written permission for the deck and sleepout but they haven't responded. How much of an issue do you think this might be for future buyers when I'm selling after completing the renovation (and leaving the deck and sleepout in place)
- If I wanted to convert what currently is a 3 bedroom to a 4 bedroom house, by turning the dining area into a bedroom (the lounge area is very large and could easily also include a dining area) would this work require consent from the neighbor under typical cross lease rules?
- Approx what is the process and price of converting a cross lease to a fee simple non cross lease title?
