Can 'Junk' or defunct and obsolete Property Title Easements be easily removed? At present, the only method is to apply to the High Court for these to be extinguished. Ouch!! you'll need at least $10,000 ...++++. You may have had to resort to this because the counter-parties (for whatever reason, ignorance, bloody-mindedness, etc, etc) refuse to surender it even though it is no longer active. In other words, the High Court can offer you a $10,000++ solution to a $1 problem .... and that's why there is little case law - not because there aren't cases, but simply because no one in their right minds would spend that sort of money just in order to tell the counter-parties to use their common sense.

I have interested our National MP in the issue and proposed that he introduce a 'Local Bill' to address the issue by providing a simple, cheap and quick legal mechanism to remove these nuisance proprty title encumbrances. However, to justify his investment of time, money and effort he requires more than just my own case. He quite reasonably has requested further examples to do battle with. So, if you are an affected owner and are attracted to the possibility of having access to this legal device to purge your title then I really need to hear from you. Off-the-cuff anecdotes are of no use to me - detailed cases are required if they are to serve as ammunition, i.e. legal propery descriptions, dates, measures, etc.
The more examples the better.
