I think chimneys and ovens are the same. Clean when the tenant gets there, clean when the tenant leaves and subject to a 14 day notice if not cleaned during the tenancy in a reasonable manor.

putting aside insurance, health & safety legislation and the actual work + equipment to do the job properly is a risk in itself. Tribunal would see this more as a maintenance issue than a cleaning matter. If the tenant was burning coal in burner not designed to do so perhaps a different case. If ever tested at TT do let me know how you get on. Cheers.

Agree with you on that point. From my observations most progress is made when an appeal is made to District Court but need make sure all ducks in order and can present a very good argument.
Im an Independent Landlord that chats with with local PMs many who have deep concerns with inconsistencies and illogical outcomes of current system. Good thing is some PMs are turning into de facto solicitors. Juicy exchanges occur daily yet overall little progress is made until upper court involved. Btw - TT hearings are open court, anyone can sit in.

Housing Improvement Regulations 1947
Landlords are responsible for maintaining any heating and ventilation provided in their rental property. If there’s a useable fireplace, the chimney or flue needs to be regularly cleaned (check your insurance policy). Landlords are also responsible for servicing ducted heating and ventilation systems.

Also, I have just browsed the bylaw noted. Can't find any reference to a chimney clean.

If landlords and others don't submit on costs, we will end up with MBIE relying on completely duff info from the University of Otago in Wellington, who went very public after the rental wof pilot back in the day saying that the average cost to bring up to standard was $50. Hahaha! We have a property maintenance firm. We don't get out of bed for $50. Academics, ivory towers .... but MBIE will believe them.
