    Hi,

    I'm really interested in a property that is coming up for auction and just wanted some thoughts and feedback on the current extra conditions listed on the S&P agreement for auction. The House is a 1920 Villa in Mount Eden and I find the weather tightness clause odd, or is it simply a standard clause most sellers put in now regardless?

    I would have thought these clauses were really only in the leaking building houses or put in contracts for houses built during that period.

    When I looked around the property it appears all original and weather boards are in good condition. Any feedback would be great..



    23.0 Weather Tightness
    23.1 The Purchaser acknowledges and accepts that neither the Vendor, the agent nor the licensee hold themselves
    out to have any expertise as to the weather tightness of the dwelling or any related issues with respect to same, nor
    have the Vendor, agent and/or licensee made any representation(s) in relation to such matters. The Purchaser
    acknowledges that in entering into this agreement, they have undertaken their own independent enquiries and/or
    investigations and have based their decision in reliance solely on their own judgement and advice received through
    their own independent enquiries and or investigations.
    23.2 The Purchaser further acknowledges, that Unlimited Potential Limited have recommended they obtain their own
    specialist expert advice in relation to this property and to seek their own independent advice (whether legal or
    otherwise) with respect to this property.

    Very sensible to have such a clause given the age of the property - i.e. 100 years old. There's probably some weather tightness issues if it's not been sorted out during a renovation (check the property file). It could have rotten boards, cladding inside and out.

      It may not mean the house is leaky or anything. They (or mainly their solicitor) just want to make sure there's no comeback on them.

        as above

        the vendors don't want new building regs used against them

        ie there may be some tiny water ingress under leadhead nails into rata? rafters

        but it's not the same as going into untreated pine

        who ever pays $3million? for it shouldn't sweat it

        and be prepared to reroof anyway
        have you defeated them?

          Just a word of warning, there are volcano caves running underground on some properties in Mt Eden. They haven't all been mapped out but get discovered once you start doing a repile on the place.
          If the house hasn't had a recent repile or you are thinking of doing an extension just bear this in mind if bidding on it.
