First of all I apologise if this is put in the incorrect thread. My wife and I are in the conditional phase of purchasing our first property and the property has a deck on it that is enclosed and roofed. We were advised that consent wasn't acquired when building was done. The Roof is attached to the roof of the house and the deck is fully surrounded by supports, 2 walls and low benches in between the supports. The benches don't sit higher than 1.5m off the ground. Part of the conditional agreement was that the vendor would remove this at their own expense if we request it.
We have a building inspection today as part of our conditions of purchase and we have asked him to look at the construction of the deck and roofing and give us an idea whether or not it is constructed in a manner that would be approved by the council.
We don't really know much about this sort of thing and we really like the work they have done. I have tried searching for the information I need but I am really not sure what I am looking for exactly.
My questions are:
What part of the deck, support and roofing fall into the category of not requiring consent?
If we get it left as it is would the process to get a Certificate Of Acceptance be more time consuming, difficult and costly than having them remove it and us rebuild it with consent?What are the consequences of us leaving it in place? Could we get fined if we want other work done around the property in the future? Would insurance cover our home? Is it likely the bank would use it as an excuse to not give us our finances?
