The tenancy of my parents rental in Christchurch recentlyended (on a Saturday). The tenants were advised by the property manager to returnthe keys on the first working day thereafter (being the Monday). My parents areplanning on selling the property and when they visited the property on theSunday, the tenant’s things were still there. They hadn’t vacated. The keyswere returned on the Monday.
My parents queried this with the manager and requested that oneday’s rent be withheld when the bond was refunded. The manager then proceededto refund the entire bond and has been extremely prickly ever since - claiming that because the house was clean etc, they have no substantive claim.
My question is: Surely overstaying by one day is a breach ofthe tenancy agreement. Is it worth taking the manager to the tenancy tribunal,or should they simply move on… As youwould expect, the manager has advised that it is unlikely that a claim would beforthcoming in the tribunal. Any body know much about this?
