I don't think we have been 'suckered" if that is the suggestion. Advice was simple and direct from a very well qualified person. "If you send a single guard on site where it was known that offenders were engaged in a the commission of a crime (or it was reasonable to have assumed that was the case) and that guard is hurt then as a director you will be liable for large fines because a court is likely to take the view that in those circumstances there should have been two persons attending and they should not have gone on site in any event."
I cannot argue with that .. all I am saying is that where once we would have left it to the guards discretion we are now required to state the procedure in writing and because I cant control what the guard may decide I have to err on the side of caution.
I doubt that any H&S consultant would say otherwise and this is supported by the Police policy (which says don't go on site if there may be offenders there). What am saying is that the new Health in Employment legislation will have a cost to this country .. What that is and whether it is worth it is debatable. What exactly is the value of a human life ?? anyone???
