Hopefully I've contributed enough to this forum to get some detailed advice from regular contributors. Main question at bottom of this post.
Situation is as follows:
Here's the kicker though. Mediator tells me that "Since there is a TT application currently being processed, the bond repayment will be held until TT proceedings have concluded" This is even though the tenant has signed the form to pay 3 weeks bond to me.
Seems to me that the mediators statement is directly contradicted by Section 22 of the RTA.
Also the remaining subsections as below aren't applicable:
Any advice on how to get the bond payment processed without waiting for the TT hearing?
Also, any idea of how to find out if the bond repayment is in fact being held up because of the TT application?
Situation is as follows:
- Tenant has vacated property, owing 3 weeks + 6 days rent.
- Tenant has signed bond (3 weeks) over to me, and refund application has been lodged.
- 14 day notice / TT application etc filed.
- Mediation phone call held - no attendance by tenant. (surprise)

Also the remaining subsections as below aren't applicable:
- 22A isn't applicable
- 22B(1) isn't applicable, as there is no dispute regarding the bond (the tenant signed the form)
- The rest of 22B, plus 22C, 22D, and 22E aren't applicable
