    Default Solicitor question

    Hi folks, I've just instructed a new solicitor and it's been suggested that I am supposed to check zoning, permits etc on the LIM myself. I'm not comfortable with this; my last solicitor did it all and just came back to me when he had a concern to raise. Is this normal practice? I feel like it should be part of the conveyancing that I'm paying for...

    Or depends how much you are paying the solicitor.

    The solicitor I used for the last 6 purchases only costs me $750 and I wouldn't dream of asking him to check the LIM for us. I completely understand that it is too much for his costs.

    The previous solicitor used to charge us $1,400 and would do those checks for us.

    Currently they want $1100 + GST + Disbursements...

    So I assume LIM check and property file check would be extra...

    We pay around $950 and would be complaining to the law society if they didn't check everything. In fact our lawyers check everything then ring me to check I didn't find anything myself :_)

    Thanks Damap, I'm pretty much committed to them this time unfortunately but will certainly shop around for the next one.. I have emailed them this morning asking if they will include it, no reply yet.

    I suppose the lesson learnt here is to agree what is inclusive in the fixed price before engaging them going forward.

    It ought really to be in the terms of engagement....what they are doing and not doing. If you've got a basement price, and the terms of engagement say that their services are limited for that price, then fair enough. If the terms dont spell it out, and they're slipping in extra costs by stealth to make up for the low price, then they are doing themselves a disservice, because I expect their new clients will get annoyed and not use them again. It's counterproductive.
