Rather than start a new thread......I am also on a crosslease and the other lessee has moved a boundary fence which is on the site plan. I was not notified prior and only found out as the fencing contractor dug a hole the day before in my private area (was not home at the time, discovered it the following morning). Approached the owner and they profusely apologised but then told me they wanted to replace the fence and I said it was shared so they should have consulted with me, so now they have moved the fence onto their private are and said they can do what they want.
The implication is probably minor to me as visually I have a bit more land but I can see this being an issue with site plans etc in the future. Whats the point in having a memorandum of lease which says you have to get your neighbours permission if in fact no one will legally enforce it.
