During the inspection it was Tenant's partner who was present, and found several people living there, rather the 'guests' and mattresses all over the place, lots of bbqs couple dogs etc. And a window was broken too
Landlord issues the 14day letter to address the window damage & to advise the number of tenants exceed the amount agreed . Tenant hasn't been acknowledged any 14 day letter or text sent.
Another inspection has been lined up as Tenant has been to difficult to get hold of, with many excuses , 'nana passed away , going up north', or 'girls netball' so forth.
Landlord asked a face to face meeting at a time convenient to the Tenant, tenant never responds.
90 Day has been delivered to the Tenant's partner , and texted the same to the tenant to inform it as an update.
It adds the numbers of people at the Property and the tension increases and before applying to TT, tenant's mother has been contacted and found that tenant now 'stays' with mom, tenant's partner's family is forcibly staying at the place , and Tenant's mother says that tenant's ex partner/she is unable to chase away her family staying forcibly at the property
It' s somehow only 'she say' 'he say' as the Tenant is not coming to talk over it. Landlord briefs that the liability for damages still lies on the tenant in the contract and suggests if able to meet up with the tenant /her son, at her place one of the afternoons and she acknowledges.
Rent payment continues through winz, also the number of people at the property increases, subsequently the damages.
In this context what could be the best pathway from here to end the Tenancy?
A) if it allows, Tenant and Landlord to meet at Tenant's mother's place and agree on a statement the Tenant agrees to vacate the premises & handover the possession of the house to landlord and endorse it through Fast Track agreement AND Landlord gets the Police to remove the people living at the house ?
And / Or
B) Tenant to lodge a complain at the police and remove the family staying forcibly? and then hand over the possession of the house to the landlord
And/Or
C) Any other reasonable suggestions to end the Tenancy and take the Possession of the house?
