I thought that any structure has to be 1M away from the boundary ? In this case it does not appear so. I was told this by council when i wanted to place a freestanding carport close to the boundary. I had a carport similar to yours except freestanding. I think your carport looks good and is a good use of space allowing natural light through too ,an added bonus.

I might need to contact the council to make sure it is legit. The builder said it needs to be 30mm-40mm away from the fence only?

Yes, should be 300mm from the boundary

5.5 Carports and similar construction
A carport is permitted to have walls and roof
with 100% unprotected area (i.e. does not require any fire rating)
provided that all the following conditions are met:
a) At least two sides are completely open to
the environment, and
b) The carport and adjacent building are under
the same ownership, and
c) For a roof plan area of no more than
than 40 m2, no part of the roof is closer
than 0.3 m to a relevant boundary
