I wonder if someone could advise me please? My son and his partner have a one year fixed contract tenancy in Dunedin in a one bedroom flat. They are joint tenants. After some family violence issues there is a restraining order on him not to go near her. I won't go into details but he will be fighting the charge in a few weeks in court. Anyway she is living in the flat and he is homeless. She is unlikely to be able to continue to live there (she can't afford the rent on her own) but I believe he will be liable for the rent, even though he is not allowed to go anywhere near it and cannot contact her.
He wants to continue living there but cannot get answers from her as to whether she wants to stay or not. How should he deal with this? Should he talk to the landlord and see if the landlord would ask her what her intentions are, so at least he knows what the position is? Does he remain liable even though he can't live there?
Please help - and I'd be grateful if you would try not to judge, as things are not always what they seem.
