We bought a house in Manukau, Auckland in an auction. The chattels include an HRV system, garden shed, heated towel rail and an alarm. The possession of the property is on 23rd of Jan 2015. When we went for pre inspection, the HRV was working only in the lounge area and the heated rail was not fixed properly to the wall and was falling off. Also, when I asked for the alarm code they told me it was inactive and a security agency needed to be contacted in order to activate it. I am not sure whether it works or not. Also, the garden shed door is fallen apart. I was disappointed with this and pointed this out to my agent but she hasn't given me a reply. I liked the house because of these extras and the agent confirmed for me all that chattels should be in working condition and I need not worry about it.
I explained the situation to my lawyer and she took it up with the vendor's lawyer and they gave the reply that they won't do any repair and they are no way liable to repair or compensate for the damaged chattels. They said that this was the condition they were in before. This is our first investment property. Can anyone help us in this situation? What options do we have?
