  • Residential subdivision using an existing ROW.

    Hey All.

    I am looking at subdividing an existing lot which is serviced by a Private ROW.

    Easement is for all services & vehicle.

    Provided my development proposal is in accordance with Council's standards - Do you think I will need to get permission from other property owners when I submit an application for Resource Consent. Do you think it will be a legal requirement??

    There are 16 residential lots (including a retirement village) currently using the lots and I want to add another 4 lots. You can image how painful this might be.

    past experience & advice would be appreciated.

    I think the answer would be yes - you need permission.
    Currently I expect you have right of way for your existing lot - you will be subdividing so have additional lots.
    I doubt they would have right of way as it stands now.
    But I'm not a lawyer so may be completely wrong!
