New to this and first post.
I am managing a property for my mother.
The tenants of this property have been renting since sept 2010. during this time there have been times where they haven't paid rent and deposited in dribs and drabs, to the point that over Christmas I got all my mothers bank statements and printed out a calender and worked in every payment, missed payment etc... right now they are owing over $2,000 worth of rent. I've given them a copy of all my workings as my mother hadn't kept very good records to begin with.
So they also have a copy of the statements, rental calender. I've given them a month to go through the paperwork and get back to me.
The issues I have are several, its been a messy arrangement from day one...
We assume that they should be paying the water bills, but didn't say on the tenancy agreement that the tenant is to pay the water, but it says on the agreement that 'if the tenants are paying water to write in the water meter reading', which is what we have done.. They have been paying most of the time, they stopped for awhile and racked up $500 worth of water billing alone, which was eventually paid back as of December. And they were told that its there responsibility to pay (volumetric charges only). They have not paid Januarys and now doesn't look like they will be paying Februarys either. The last couple of times I have been over there to talk with them, The tenant ( male) said that it felt like I was harassing them. which makes things difficult as they are in the house right next door.
So Id like to get everything ready to go to Tribunal. My parents are retired and are good people. They like the tenants and they look after the house, but don't pay the bills...
I misunderstood the rent in advance from the beginning of the tenancy, I assumed that that money goes towards the week/s when they say they are moving out.
So in order to tidy the rental records up... I'm assuming I have to refund the money, alter my spread sheet from the very beginning and it will be taken up from the rent money owing?
Tenancy commenced on 18/09/2010 paid $370 for week in advance and first rental payment came out on 23/09/2010 for the period of 23/09/2010 - 29/09/2010

How would it be best to incorporate it ready for Tenancy Tribunal as its only 6 days from start date 18/09/2010 - 22/09/2010
