We moved into a house back in May of this year, the house pretty much reflected the very cheap rent for a 3 bedroom house in Auckland. The tenancy had its ups and downs, but at the start of this month we decided it was time to move out. Our final inspection was yesterday and I knew there were things such as the oven that needed cleaning (this was impossible to clean) and that there was a bit of overdue money for water bills which I was happy to assign money out of the bond for. However our property manager took up several more issues with us.
She has claimed that we left window sills, kitchen cupboards, vinyl and tile flooring and the laundry tub plus a few other surfaces 'filthy' and that she was wanting to get cleaners through to clean the surfaces that were supposedly 'filthy' she went over the top of a kitchen door with her pen and was scraping the paint off the top of the door, not dirt. The house hasn't been looked after all by previous tenants and the kitchen is original so around 60 years old, I would say the paint job would be 5-10 years if not longer old. All cupboards are heavily stained on the inside, when we moved in we scrubbed trying to get them clean but no luck, we cleaned these when we moved out but no luck again they were clean but still stained. Same story with the vinyl and tile flooring as well really only the vinyl and tiles would be 5-10 years old. The laundry tub is original and covered in rust. Window sills same story again.
She also said that the lawns (which are still a work in progress due to the weather) need to have a catcher used for the lawns. When we viewed the house the lawns were as long as they currently are and they were cut before we took possession of the property and the lawns were not mowed with a catcher. She said should we fail to use a catcher she will pay someone to do it and take it out of our bond.
I have told her that I am happy to assign her $30 for the oven cleaning and pay the outstanding amount for the water bill out of the bond. But she insists of the lawns being mowed with a catcher and bringing cleaners through to clean, I have tried yesterday and today to come to an agreement with her but it's not working. The thing I am wondering here is I have photographs to back up all my claims, what are my chances likely to be of succeeding in the tenancy tribunal? is there anything any of you can recommend to include when applying to the tenancy tribunal?
