    CONDITIONS OF TENANCY

    The conditions of this tenancy agreement shall be read in conjunction with the provisions of the Residential Tenancy Act 1986 and its amendments.

    AGREEMENT:
    (1) The landlord and tenant shall retain a copy of this agreement, amendments and notices pertaining to the tenancy of the property.
    (2) Any amendments, notices and terminations are to be notified in writing.

    DEFINITIONS:
    (3) For the purpose of this agreement, the tenants address for service shall be the address for which this agreement applies, and the property is the address of tenancy as described in the tenancy details.

    BOND:
    (4) The bond shall be made payable to the “Residential Tenancies Trust Account” and paid to the Bond Centre within 23 days of payment.
    (5) The bond shall be refunded in full on the termination of this tenancy, provided that;
    (I) The landlord suffers no loss or damage to the property.
    (II) All obligations have been met under this agreement.

    RENT:
    (6) Rent is to be paid regularly on a weekly basis, by automatic payment.
    (7) Rent shall not be increased within 180 days of the commencement of the tenancy or last rent increase.
    ( Rent increases shall be notified in writing 60 days in advance.

    SUBLETTING AND ASSIGNMENT:
    (9) The tenant shall not assign, sublet, either as a boarder, flatmate, extended guest or
    co-resident of any description, or part possession of the premises, property or chattels, or any part thereof during the term of this tenancy without the agreement of the landlord and amendment signed by all parties to, or added to this agreement, either in the capacity of a tenant, flatmate or boarder other than those already listed in this agreement.

    RENOVATIONS AND ALTERATIONS:
    (10) The tenant shall not renovate, make any addition, remove or dispose of in any way; any possession or part of the premises, property or chattels during the term of this tenancy without the agreement and written authority of the landlord.

    TERMINATION OF TENANCY:
    (11) The tenant shall give at least 21 days written notification of intention to terminate tenancy. A termination form is provided in this agreement.
    (12) The landlord shall give at least 90 days written notification of intention to terminate the tenancy. This may be reduced to 42 days notice as defined in section 51(1)(a) of the Residential Tenancies Act 1986, whereby;


    1. [*=-1]The landlord has an agreement to sell the premises with vacant possession.
      [*=-1]Where occupation is required by the landlord or a member of the landlord’s family.



    CONDITIONS OF TENANCY

    The conditions of this tenancy agreement shall be read in conjunction with the provisions of the Residential Tenancy Act 1986 and its amendments.
    RESIDENTIAL USE:
    (13) The tenant shall ensure that the premises are occupied principally for residential purposes only.
    (14) The tenant shall not cause or permit the premises to be used for any unlawful activity, or through any act, cause the landlord/property owner to be in breach of any statutory act or bylaw.
    (15) The tenant shall ensure that any activity does not interfere with the reasonable peace, comfort, or privacy of the landlords other tenants in the use of the premises occupied by those other tenants, or with the reasonable peace, comfort, or privacy of any other person residing in the neighbourhood. Should there be such an instance, whether it is intentional or otherwise and the tenant has been made aware of such, the tenant is to notify the landlord to help resolve the matter. Note: Failing to notify the landlord is also a breach of this agreement.
    (16) Only the original pets, (if any) listed in the tenancy details, or those amended to it are permitted on the property. No additional pets are to be kept on the property either by the tenant or guests of the tenant, under any circumstances.

    RIGHTS OF ENTRY:
    (17) The landlord shall be permitted to enter the premises only;
    (I) With the tenants consent at the time of entry.
    (II) In an emergency.
    (III) After 48 hours notice of inspection.
    (IIII) After 24 hours notice for repairs and maintenance.

    MAINTENANCE:
    (1 Should there be any maintenance repairs necessary, the tenant is to notify the landlord as soon as practical to arrange repairs. Failure to do say may result in subsequent deterioration and the tenant being held liable for the damage.
    (19) The tenant shall maintain the grounds, lawns and gardens of the premises in an acceptable condition and free from any accumulation of rubbish, which includes cigarette butts.

    TENANTS RESPONSIBILITIES:
    (20) Not to damage or permit damage to the premises under any circumstances.
    (21) To notify the landlord of any damage or possible/pending damage, of any description whatsoever to the property and not to let damage progress should this occur.
    (22) Pay electricity, gas, television accounts, telephone charges and any other accounts or expenses incurred relating to the tenancy regularly and make any arrangements that may be necessary for final payments at the end of the tenancy.
    (23) The tenant shall keep the premises in an acceptable clean and tidy condition as the Residential Tenancy Act permits. Which will include all fly marks on ceilings/light fittings and wall surfaces, mould and dirt build-ups on window/door joinery and seals. Dirt/hand marks on walls and doors.
    (24) Leave the property clean and tidy and free of rubbish and possessions with all lawns mowed and grounds kept to an acceptable manner at the end of tenancy.
    (25) The tenant agrees to maintain insurance for personal contents and/or liability in respect of the landlord’s property and chattels, for the duration of tenancy.
    (26) The tenant shall be responsible for the cost of replacement of any damaged chattels of an equal value and agrees that the chattels are fairly described in the attached schedule.
    (27) The tenancy shall end, with the keys returned to the landlord no later than 1.00pm on the day the property is vacated. The final inspection is to be arranged before or at that time.

    TENANCY AGREEMENT

    The conditions of this tenancy agreement shall be read in conjunction with the provisions of the Residential Tenancy Act 1986 and its amendments.

    All tenants, both jointly and severally that form part of this agreement, have read the conditions of this agreement, understand and agree to abide by them fully subject to the Residential Tenancy Act 1986.

    TERMINATION OF TENANCY AGREEMENT

    The conditions of this agreement shall be read in conjunction with the provisions of the Residential Tenancy Act 1986 and its amendments.

    This form is for the termination of the tenancy agreement for 5B Beckons Ave Hamilton. The notification is to be signed and presented at least 21 days prior to the final date that the tenants wishes to terminate the agreement. On presentation of this form, the tenants acknowledge that a pre-final inspection will be necessary at least seven days prior to the final day, purely to outline any expectations and obligations inline with this agreement, for the purposes of ensuring a comfortable transition for future tenants and to ensure minimal time in the bond refund process.

    The tenants are to notify the electricity/gas and telephone companies for final readings and accounts prior to termination. The final reading for power is to be taken on the last day/day after termination. The tenants agree to inform the electricity/gas and telephone companies of a forwarding billing address should this be necessary. For the protection of the tenant, it is recommended that a record be kept of the final meter readings and dates of notifications/acknowledgements of discontinuance to avoid arguments in discrepancies with future tenants and authorities should this occur.

    As good tenancies rely on trust and respect from all parties and recommendations from others, a reference will be given to help the tenant in obtaining any future tenancies, if requested. Adversely, the tenants acknowledge that any negative aspects may be registered with Tenantlink a division of Credit Operations Ltd.
