I have a concept that would resolve all bad tenancy issues, namely neighbor from hell tenant scenarios.
The problem:
Stated in the tenancy agreement, the tenant has responsibilities to:
Not disturb the neighbours or the landlord's other tenants
This is rarely enforced. It is the landlord that calls the shots here and decides whether to take action. Since they have a profit driven vested interest FORGET IT! In most cases, many landlords ignore the above tenant responsibility of not disturbing neighbors. My street is living proof of this!
This makes no sense, here is the "Neighbour" listed in the tenancy agreement, yet the Neighbour has zero rights within that agreement. The agreement is between the tenant and the landlord. THAT is the problem.
The solution:
Not disturb the neighbours or the landlord's other tenants is amended to:
Not disturb the neighbours or the landlord's other tenants (at such a time, neighbour(s) or the landlord's other tenants can file an application to be brought into the lease agreement. Once part of the lease agreement they are able to give the tenant 14 days notice and failing any result, ultimately evict the tenant).
The application to be joined to the lease agreement is granted when Police or noise control present suitable evidence that there is a valid disturbance. The neighbours are then brought into the lease agreement strictly in the realm involving the clause that the "tenant must not disturb neighbors".
I think this is completely and totally fair to all involved. It is ludicrous to list the neighbor in the agreement and give them no rights to fight said tenants who cause a disturbance. There is a safeguard in that the neighbor must have very solid evidence and support from the city to warrant being brought into the agreement.
I believe this is a silver bullet that could change the entire way these tenants behave and the landlords who allow them to behave this way. Problem tenants will no longer view neighbors as helpless but as people who could evict them.
So, how does such legislation get created? I'm afraid politics is not my strong suit but I am willing to learn and fight to make this happen.
