With the number of mortgagee auctions on the market, it is time for investors to understand some of their legal ramifications and be fully prepared for purchasing these properties.
Phil Sheat from Steindle Williams Legal will be speaking on what investors should be aware of from a legal point of view when buying at a mortgagee auction.
Phil will speak on:
due diligence - quick run down on what is required and why it is important for mortgagee sales with regards to lack of vendor warranties etc
understanding terms of sales prior to the auction
common buyers risks at auctions and how to navigate through them
issues relating to settlement such as no guarantee of vacant possession on settlement)
Phil graduated from Victoria University in 1980 and was admitted to the Bar in 1981. He has practiced extensively in New Zealand and Australia where he was admitted to the Bar in 1989. Phil's areas of practice are primarily the commercial, property and trusts fields. He advises clients on the buying and selling of residential and commercial properties and businesses, transaction structuring, securities and estate planning including the establishment of family trusts. Phil is a member of the Auckland District Law Society Documents and Precedents committee which drafts, amends and updates many of the documents used by the profession throughout New Zealand. He is an active Rotarian (Paul Harris Fellow).
