would appreciate advice on the following scenario. A property is purchased with a clean title, after settlement an encroachment licence is presented and it is pointed out that reference is made to it in the sales and purchase agreement under legal description where it states there is an encroachment. The encroachment licence is dated the day of settlement ie after offers are made and it is between the prior owner and the adjacent property, no reference is made to the new purchaser. Any idea where the new owner would sit?
