Situation.
Older male (30) talked younger female(19) into takking over the responsibility of another female tenant who wanted to leave. Duly did so signing standard realestate tenancy as jointly and severally liable.
Female tenant has paid rent to male who has got behind bu spending the rent and water money and has allowed up to seven occupants in the house despite females requests and arguments to not do this. (Yep he's scum bag.)
Over the holidays while female was away he moved another male freind into her room and moved her into a samller room. Not consultation, nothing.Not sure how much rent he is collecting.
Female has now moved out as she feels threatened and has been found other accomodation.
Male refuse to talk to her without threatening behavoir.
Female has contacted agent who has some sympathy for her predicament and despite her texting and phoning the male he refuses to even acknowledge her calls to come to a meeting.
Female has had meeting with agent. Agent has decided,
1. To do an inspection pronto to see who is living in the house as a flatting situation 2 were permitted.
2. To issue 90 days notice as she has had enough of this guy.
3. Considers her hands are tied unles the male will agree to an interview and to sign the change of tenant form allowing female to exit the agreement. (won't I suspect because his male mates won't be acceptable.)
Problem here is at what point does the liability cease for the female that was basically pushed out of the house she holds half the tenancy for and what can she do about it.
If the Agent gives a 90 day notice and the male stops paying and causes damage etc the female remains liable and as the one repsonsible person will get lumbered.
Even if she gives a 21 day notice he has to agree.
He refused yesterday to attend the meeting with the agent and refused to meet with the female unless on his terms at the house where she feels in danger. Probably will still refuse to sign the form.
Not a nice situation for her.
Anyone got a suggestion as to how we can deal with this.?
Aside from a couple of heavies which may be needed if the nice way or legal way fails.
Surley there is a way in the RTA but I've not come across it.
