We took on a lease approx 2 years ago and now have to move because the premises have become too small. The landlord gave us a 2 year lease with right of renewal for 3 years. We have found new premises as the 2 years is nearly up. I have told the landlord by email and he has acknowledged us.
As we painted the room in our business colours (fairly neutral), he has asked to repaint back to neutral colours. Fair enough can do.
But when we moved in the space was divided into partitions. As a condition of taking the lease we needed the space open plan and the partitions removed. He agreed. He removed them however he is now asking that we replace back them at our expense. Can he do this when he agreed to remove them and that what was verbally agreed upon at the time of taking on the lease? He made no demand of them ever being replaced.
I am on the standard auckland district law society 2008 lease.
