We have a brick retaining wall on our boundary (our boundary is with a residential neighbour). The wall needs replacing. The neighbor has cut away some land on their side which may or may not have contributed to the wall needing replacing. Anyway we are going to replace the wall at our own cost but the neighbor has hinted that a wood wall would be good. I know retaining walls are not defined as fences under the Fencing Act 1978 but are retaining walls on boundaries potentially a shared cost between neighbour’s like a fence is? We just want to know in case they start demanding what the wall should look like and we can say that unless they want to share the cost then we can do it how we like (within reason and asthetic). It would be under the 1.5m so no consent required.
