    Hi everyone!

    Just been googling for some advice and stumbled across this forum, so hopefully you can help.

    The wife and I arrived in NZ in December from the UK and we love it here. We initially thought we'd had a long wait for our visa to come through so when we looked for rentals we were more than happy to take a 12 month fixed term on a lovely apartment in Takapuna, North Shore City which we are currently 6 months into.

    Now, we love the apartment and the complex we are in, its perfect for our needs until we decide to buy, however we have a nightmare with the next door unit.

    About a month after we moved in we noticed the next door unit would slam there front door extreamly loud whenever they opened it. There are 3 people living in the 2 bed next door and what started as a few loud slams a day/night, has over the last few months escalated into slamming every 30mins from 7pm onwards, all the way until after midnight, and at weekend around 4am as well.

    Initially we complained the building managers, both about the noise and also that they were leaving bags of rubbish outside there front door (and next to ours) for days on end. The building manager told us they have had problems with them in the past regarding noise and rubbish, and that the tenant has an anger problem but she'd speak to them. Anyway, she has a couple of times and although the rubbish has stopped, the door slamming gets worse. We complained again and she told us to speak to our landlord, who turns out to be there landlord too.

    Now, we spoke to our landlord and he said he's warned the neighbours before about it so would do it again. Still no change in the noise so we complain again and he issues them with a 48hr notice to stop it. In fairness it did stop and we told the landlord this, but then a couple of days later it starts up again even louder. We have complained twice more to the landlord and he says hes warned them, but last night we had enough. We are barely sleeping now because the slamming is so loud and at such weird hours that its taking a toll on us, and we are at the point we want out. We told the landlord and all he said was "he is bound by the tenancies act".

    What are we supposed to do? We can't sleep, and the apartment/complex we loved when we moved in, is now a nightmare because of the noise.

    Any ideas?

    You're lucky the landlord is also your problem neighbour's landlord.

    Go to the tenancy website at www.tenancy.govt.nz and read about "10 day notices". Issue your landlord with one of these, it basically gives them 10 days to sort out the problem. When the problem continues make an application to the tenancy tribunal for the tenancy to be terminated.

    You could also make the ultimatum to your landlord that "it's them or us" if you'd prefer to stay there.

    If you want to increase the pressure on the landlord talk to your neighbours and have them complain to the building manager (assuming it is annoying them too). The building manager will then annoy the landlord

      I agree that it is fortunate that you have the same landlord. Refer Residential Tenancies Act section 45 subsection 1(e) http://www.legislation.govt.nz/act/p...l&p=1#DLM95099 . The 10 day notice is the correct course of action.

      I would have thought it was a trivial matter to install a mechanical door closer making it impossible to slam the door. I hope you can get this sorted soon!

        Thanks for your help guys.

        We have already mentioned to the landlord that unless this is resolved soon we will be looking to terminate our tenancy, which was a couple of email exchanges ago now, but now I can read up on the 10 day notice action.

        Its frustrating as once our rental was up we were either thinking of extending as we really like the apartment, or looking at buying our first home, but because of the problems we are having and the effect is causing on us, we feel like we are being forced out now when we don't want to go, but we can't stay with the situation as it is now.

        Frustrating as the landlord isn't just some bloke who owns a couple of apartments, but its managed by one of Auckland's largest rental companies.

          Make sure you personally deliver the 10 day notice otherwise you need to allow a few days for postage.

          You can speed the process up further by making the tenancy tribunal application as soon as you have delivered the 10 day notice.

          Now you've mentioned it's a large rental company you may want to try going to the boss. It's possible the person you are dealing with just hasn't realised how bad things have become.

            The landlord has actually be really good recently as we know he is speaking to them, so I know he is trying to help us. Its just frustrating for us as the noise is so bad at times, last night being a prime example, that you go to bed at 2330 to avoid the expected noise earlier, then just after midnight when you dropped of to sleep, SLAM, and now your bolt awake. The wife and I are totally knackered most of the time now and its wearing us down.

            Don't want to leave as we like it there, but I dont see how we can stay if nothing can be done about the slamming.

            Will give it a couple more days as we only emailed him again this morning and he's promised to speak to them again, so will see how that goes.

              Good luck. It does sound like the only solution is for him to get rid of them and that process takes time.

                That mechanical door closer sounds like the solution,Does the landlord know about this?
                All he has to do is give the required notice,put it in, and presto,problem solved.

                    I thought all apartment buildings had door closers on the front door of each apartment door. It's to make sure the door is closed in a fire as the front door is also a fire stop door. Still worth suggesting though.

                      Stop emailing. Put it in writing. On paper. Hand deliver it. Keep a copy. At the end of the 10 days do it again. In writing, on paper and hand delivered. Do it a third time and apply to the TT for termination due to a breach of Section 56 by the landlord.

                        Even if the landlord does everything he can, the tenants obviously don't care. You need them to be evicted. As stated above and earlier, apply for termination.
