Notice within a 90 Day Notice Period

Hi Guys,

Please indulge me as I know this is an old chesnut but I can't find the relevant thread.

Once you've served a tenant with a 90 day notice to terminate, do they have to give 21 days notice if they want to leave prior to the end of the 90 day period?

Yes they do. (Except where the premises are destroyed, in which case notice is no less than 2 days.)

A LL can agree to a shorter notice period, but cannot require a longer one.

That was my recollection from the previous threads but it's good to have it confirmed. Fortunately no destruction in this case!!!
