After my tenant commenced his tenancy, within 7 days he complained that the automatic gate opener/intercom/security system wasn't working.
In fact, we haven't been using the gate for more than a year. We never advertised the place as having an automatic gate, after having problems over many years decided not to repair it. My electrician estimates it will cost $5000 to repair, or $15,000 to install a new system (!).
The tenant says that on his initial inspection of the property, he saw the system in place, and assumed that it was working. He says that with a one year old toddler, and the property facing a busy road, that the gate not automatically closing interferes with his peace of mind and enjoyment of the property. He says that I had an obligation to explain that the system wasn't working if I had no intention to provide a working system.
I don't know what my options are here - the tenant has said he is very unhappy with the situation, but has signed a one year FTT. He mentioned the Tenancy Tribunal, but hasn't done anything such as issue a 10 day notice (on what grounds I don't know yet).
If he does take this to the tenancy tribunal, is he likely to get any satisfaction? The property is in a fairly nice area, and he is paying what anyone would consider a premium rental. I really don't want to shell out to repair this...
