Ok, our tenant moved out on Friday - last Friday.
It's now Tuesday (4 days later) she is screaming about her bond.
She wants her bond.
Bond bond bond *stamps feet*
Well first off she left some mess (full, leaking garbage bags) and a wall needed to be painted so we said "Sure you can have your bond - minus $40 becuase we will have to paint the wall you put marks over"
We had to explain this ^^ to not only her but her friend and her grandfather who she got to call us on her behalf.
So she came back and used our paint and equipment and painted the wall. All good.
I was with her while she painted and I cleaned her bathroom (she didn't bother to thank me) but I digress...
Then she wants her bond, naturally.
Fine we say, just give us a few more days to make sure your rent was current - we just noticed that you stopped paying 2 weeks ago but didn't have 2 weeks up your sleeve.
So she screams about that and calls some tenancy association who grin and clap their hands when she tells them we never lodged her bond.
Which she knew about all along.
Now the maximum penalty is $3000.
She will not be entitled to her bond back - so far this year she is about 6 weeks behind in rent!! Her bond was only $640. Weekly rent was $160.
She has been paying her rent every 8 days, and other such shenanigans... stealing from us for a year.
We have been good landlords.
We allowed her have a friend stay with her for months.
Allowed her use of our pool without asking for either a single $ towards pool chemicals or any other sort of maintenance including cleaning.
Let her use our BBQ without asking for a contribution towards gas (which she is obliged to pay under the terms of our tenancy agreement)
Did not kick her out after she hosted parties in our absence. (The other tenants told us about the parties)
Did not evict her when we found out that she had used drugs on our premises. (But we did have a meeting about that)
Allowed her to not pay us rent for several weeks when she took time off from work to go interstate (she promised to catch up but we're not sure if she did anymore)
Gave her our internet password so she could use our internet for free.
Allowed her into our house every time she asked to use our washing machine and dryer - without ever asking her to contribute to the electricity or to clean the laundry. ever.
In fact, she never had to pay electricity - or water even though she had a habit of hour long showers which were restricting our other tenants, and she had a habit of leaving all the outside lights on all night long.
Anyway, I guess I'm venting now... grrr... I'm not happy.
Anyway does anyone know how much trouble we will be in???
We admit we did not lodge the bond, it's the only thing we've done wrong.
The tenant knew that we were not intending to lodge the bond and she agreed to that - do you think that makes any difference???
Please help.
