I bought a business in 2005 and took over the existing lease. 3 months later the building was sold and a new landlord took over the lease. I had a 6 year right of renewal which came due a year after the new landlord took over. My lawyer wrote to the new landlord to advise him we wished to renew. I have had a rent review but the landlord has refused to advise me how much I'm supposed to be paying, despite me writing and asking for clarification, so I have continued to pay at the old rate. Three years down the track I'm still waiting for my lease renewal. It seems I'm on a month by month lease, but what does this mean in terms of what my obligations are? Last year the landlord walked in the door with a bill for three years of rates and outgoings but had never given me any indication prior to that what he expected me to pay. I would prefer to pay on a monthly basis to avoid a huge bill like the one he delivered to me. Do I have a lease? Do I have to give any notice if I vacate? Do I have to pay rates & outgoings when I don't appear to have any legal agreement about what they are and have had no fair and reasonable opportunity to pay them in a manner which allows me to manage my business efficiently. After a significant theft from the business and the current economic downturn I'm now insolvent any way, so what am I supposed to do?
