Who should pay for tank refills when the water is used up?

My rental agent says that it is law for the landlord to supply the water if the tenant uses it up. ie Not negotiable.
Our tank must be about 10,000-15,000 litres.
We also have spare water tanks of 2,500 L and 3,000 L (aren't rigged to supply the house, but OK for emergency).
The tenants have needed three refills, and now, a plumber is blaming our concrete tank (which leaks - as they all do), but until I have a second opinion on that, I just don't buy it. It has leaked ever since we owned it, and we never ran out of water unless we did something silly - even with 5 people there during Summer.
