    WHY IS THIS SO IMPORTANT?

    The NZPIF had a meeting on Thursday with Department of Justice officials who are conducting a review of regulations for Property managers. This review was undertaken at the request of the REINZ and a condition of the then National Opposition Party for their agreement on the new Real Estate Agents Act.

    Under the new REA Act, Property Managers are excluded. Previously any Property Manager who was affiliated to the REINZ was effectively regulated under the REINZ. The REINZ have argued that regulation is still required and should apply to all Property Managers, not just REINZ ones.

    The aim of the Ministry of Justice review is to identify any risks that consumers (Property Investors employing a Property Manger) face and consider possible options for regulating Property Managers in order to address these risks.

    Regulation can take many forms and while they generally improve the services that consumers receive and help to reduce the risk of problems, over regulation can be expensive and unwarranted.

    It is important for the Review Team to identify if any problems or concerns exist, their scale, whether they need to be addressed, if any regulation is required plus the most appropriate form and level that regulation should take if it is required.

    HOW CAN YOU ASSIST?

    The Review Team is very keen to identify what problems and concerns property investors have regarding Property Managers so that if any regulation is required, it actually addresses these factors and does so at an appropriate level.

    To help them get good information and make good recommendations, the NZPIF has very quickly developed a short web-based questionnaire to gauge Property Investors opinions.

    This is a wonderful opportunity for you to have a say in what may be a crucial area of your rental property business. We are looking for the opinions of people who regularly use Residential Property Managers to look after their properties, plus investors who use Property Managers infrequently. This could be to find tenants, provide rental assessments or conduct property inspections.

    The questionnaire is very short and it is crucial that we get as many property investors answering as possible to make it more accurate.

    The timeframe is extremely short (Justice requires an interim reply by next Wednesday (November 19) and we would appreciate it if you could complete the survey as early as you possibly can.

    This is your chance to have your say. You can also register your email address to receive a public discussion document from the Ministry of Justice after they have written their findings and made recommendations to Government.

    Well, if the present 'regulation' of REA PMs is
    anything to go by, the statement:
    Regulation can take many forms and while they generally improve the services that consumers receive and help to reduce the risk of problems, . . .
    is somewhat farcical.

    While it may not be ideal to have too much that's
    negative, perhaps it would do little harm to gather
    some examples of how well 'regulated' REA PMs
    have served PIs, thus far?

    One could even ponder how well the RTA is at reg-
    ulating and therefore improving the services which
    PIs get!
