Someone I know sent me this email today.
Hi Glenn,
I just have a question for you, we are recently applying for an apartment to rent in Akld, as one of the questions it has raised conerns forme the wording is 'Are you pregnant?' Can a landlord or manager officially ask this of prospective tenants?
It's not something i would disclose, but more so I found it alarming on an application form
Look forward to hearing your thoughts around this
This was my reply.
My goodness someone is a bit foolish on their application form.
Next question might be do you have sex or use contraceptives.
When a silly landlord puts something like that on an application form they are "in my opinion" asking for trouble. The evidence is there for others to take action against them.
This is what the current law says. Section 12 of the RTA Discrimination is an unlawful act.
$3000. However it could go to the Human rights commission and then that is $5000.
The RTA is up for review and the penalty for this sort of discrimination is being increased to $4000.
However it is possible to apply to the tribunal and have children excluded from tenancies.
I seriously doubt anyone could get a blanket exclusion on the basis that someone was pregnant or fertile or what ever.
So folks what do you think.
Has anyone else seen an application form like this.
If you have publish their name on the forum.
