New Tainting Rules re Property Trading under a “Trading Trust” & Buy & Holds under LAQC.
Under the new laws of association and tainting from the IRD that comes out April 2009.
Does property trading under a “Trading Trust” taint your Buy @ Hold properties held under a “LAQC”.
I am looking at starting winter 2008 and want to get this right from the start.
Currently under the associated persons test contained in section OD 8(4) of the Income Tax act the Trading Trust is not associated with either the Family Trust or the LAQC. Accordingly the property trading will not taint any property acquired in either the Family Trust or the LAQC.
Does this still hold true under the new laws of association and tainting ?
