21 days rent arrears

Hi there,
How do you go about getting tenants out who are soon to be 3 weeks in rent arrears. They have been served a 90 day notice and seemed to have gone"dog" on us now by not paying the rent. We have given them two 14 day notices after each week of arrears and believe they will not pay again next Monday, so what move can we make next?

They need to miss four weekly rent payments to be 21 days in arrears. Two optioons for you:

1) Apply now for termination

2) Apply when the fourth weekly rent due is missed.

By the time you get a TT hearing you'll be past the 4 weeks.

Indeed you may. However, if they pay in dribbs and drabbs you are not guaranteed a termination under S56 if they are not 21 days in arrears at the hearing date whereas under S55 you are. Just a matter of deciding if an 8 day wait is worth the guarantee.
