  • Adding units on land with two cross-lease titles

    I'm in the process of obtaining building consent to introduce two additional units and a shared carport on a property with two cross-lease titles, both under my family and me.
    The Auckland Council has now raised a query regarding the legal basis between these two proposed units and the shared carport concerning these two titles.
    Before I seek legal counsel, I'm keen to hear from anyone who has navigated a similar situation?
    P.S. also, confused why AC is raising this after granting resource consent?​

    Speak to a lawyer- maybe you need an agreement for the use of common areas.

      They may be raising it as issue now if you are building over boundaries or on/near Neighbours. Resource consent always has condition that building consent will be applied for and pick up all non planning issues?

      maybe you should freehold at the same time or unit title including new units?
