  • Ex-state duplex

    Could someone let me know the likely legal description, (not sure I'm using the right terms here), eg cross-lease? I need to know the amount of autonomy a new owner might have to expand the building footprint.

    Did you watch Fair go last night ?
    The interesting thing about cross leases, apart from the fact that you cant build on your part without the permission of the other half, is that total building coverage is calculated for the whole section, not for each part individually.
    So if the neighbour extends their place, that is reducing the amount you could extend yours.

      Yes I did see some of the program. It's quite complex living on one at times. I would avoid them in future. The property price usually reflects the disadvantages.

      But I was wondering if ex-state duplexes are cross-lease? (I don't think I explained it well enough in my first question).

        Hi BB. You will probably find most Ex State Duplex houses are on freehold titles. Easy to check anyway. Do a title search or free search on your council's website (under the rates section). Make sure it doesn't state 1/3 share of 995m2 or that there is a separate title for (say) 36 Smith St with 36a and 36b listed underneath.
