  • Joint tenants to tenants in common?

    I've looked around and I can't get a clear answer. Do I need my ex-wifes consent to sever our joint tenancy agreement and enter into tenants in common?

    So looking at the terminology - you've got a house with your now ex.wife (legally separated or divorced).

    Joint tenancy - neither you nor your wife own a share in the property - you both own it and if one dies the other gets it.

    Tenants in common - are shareholders of the property. Could be equal or unequal shares and each can have their share part of their will.

    Clearly, you will need a lawyer and you can not change a title and ownership without following due process and legal representation.

    Jointly owned assets are part of the separation and divorce settlement.
