I live in a nice normal residential family area.
I have lived here for 8 years and then a year later my neighbors moved in. We share a driveway with my house at the front.
I have had a problem with this neighbor over the last few years where she has been cleaning the driveway and dumping the waste in my garden that is along the drive and is on my property. She also cuts back my rose bush and any other dead looking flowers - on my property.
I have told her off about this and told her she cannot touch my gardens. If she wants to sweep the drive she has to dispose of the waste in her garden bin or on her property. To which she told me once, she couldn't put it all in her bin.
I also caught her cutting down one of my tree branches over-hanging the drive-way, which in no way hindered any cars as it was up high. I told her that if she had a problem with trees overhanging the shared driveway, out of respect to me, she should consult me first.
I have no problems with her cutting down any brunches that overhang on her side of the fence on her property and have told her to cut them if they bother her. But when it comes to the shared driveway, I just want some respect and consultation.
This women is quite a bit older than me, she has adult children, where as I have school aged children. She is also upper class, where-as we are middle to low working class. She is also very pedantic about her property looking pretty and immaculate.
I just did a major cleanup on the drive end of November and again at Christmas, but this woman wants me to do it more often. I had her knock on my door, lead me up the drive and yell at me about 9 leaves on the drive that she didn't want to blow up to her end of the drive. To which I told her I can't stop the leaves falling of the trees or control the wind and that it was ridiculous of her to expect me to sweep up 9 leaves to prevent them blowing up the drive. I don't see her going to the neighbors next door and complaining to them about the leaves from their trees that overhang our drive. But I did see her once chuck a big green leaf (those big green fan shaped leaves) back over the fence into their property.
I am a seasonal gardener, normally do a good clean once all the leaves fall. I don't bother doing much in winter with all the storms and wet. And then once spring/summer hits, I like to keep it clean as we entertain a bit. But I am not going to let my gardens rule my life.
We've also had a problem with her closing our open gate on the shared driveway - out of many reasons - first was, she didn't want her grandson to see the trampoline as he'll want to play on it. Which I had no problems with him having a bounce or two. Then when I said that, she said it was because they didn't want to run over my children if they ran out on the drive. My kids are 9 and 12 and they know not to run out or play on the drive - unless I am watching. My son likes to Skateboard on it. Then the third reason was, that she couldn't understand why we needed a gate there in the first place, to which I replied it was the only access for the lawnmower man.
I gave her a warning, stating that she has no rights to close the gate (it opens inward to my property) and that it is trespassing. I told her that she is not allowed to do my gardens and that I would get a trespass order.
I know people would love to have someone do their gardens. But this woman is controlling, likes to have things done her way and when she wants them done.
Today she was sweeping the drive. Don't mind that. As I have done it twice already since Dec. But a cyclone and stormy weather is coming, so it will need to be done again. But once I caught her chopping down the wisteria vine in my garden I yelled out the window - what are you doing cutting down my plants on my property? To which she said "It is so we can get the cars through".
No vine was overhanging the drive to obstruct a vehicle. I only have the soft leaf plants doing their overhang thing, as that is what those plants are supposed to do. Just had to look up the name of these plants - Agapanthus - didn't get the green fingers from my Nana or Aunty.
My plants were not obstructing the drive, cars can get through easily. They drive hatchbacks. I had no problems with her cutting the ferns on the left hand side of the drive, as that is not my garden, but ferns that grow through from the neighbors, so if those ferns obstruct her, she can cut them back - no problems.
My question is, do I follow trough with the trespass order, after years of telling her not do disrespect us and that they just ask us if they need something done?
