We have held a rental since 2004. It’s at a stage of needing maintenance, it’s had its dux qest issues and now we wish to access the bathroom and kitchen walls to remove the balance of dux and replace the leaking shower and kitchen benches etc.
It’s prudent to have the house vacate to enable this work, my question is if we were to give the tenants 90 days notice and occupy it for 4 months while we carry out the refurbishment and continue to pay into the rent account the current rates, insurance, interest and 5% of weekly rent as nominal maintenance can we continue to claim expenses as if the property were rented during the reno? Once the work is complete we will immediately depart and re tenant. Can we claim the reno maintenance expenses incurred for the 4 month period as if it were/is tenanted? Or is it better to pay nothing and claim nothing during the reno period that its untenanted?
We personally don’t see we are gaining but how would this proposal sit with the IRD. The IRD Rental Booklet covers “Moving back into your own home” but their example is if it was permanent but this is not our case. The state wants landlords to improve rental stock, but it not always that easy in terms of access and no income vacancy periods to enable. Thanks for comments.
