How/when can I get rid of smokers

I tried searching on smoking on here, but the search results seemed to return every second post on here with no specifics. I have new tenants moving in and found (when I visited their existing place to sign bond lodgement) that one is a heavy smoker. The tenancy agreement has a specific clause stating no smoking and I have told them verbally and in my welcome pack document that I will not tolerate any smell of smoke in the house when I do any inspections.

My question is what is the process if I do smell smoke? is it a 14 day notice? how if it it persists can I move them out?

Was their application form filled out stating they were non smokers? If so, apply for termination now as thy decieved you.

Hi Keys, No, I used the Tenancy Services application form. But the tenancy agreement stated no smoking and the trademe ad said no smokers. Also I have stressed during initial conversations and at handover that there is absolutely no smoking in the house.
